White-Label & Corporate Partner Policy

1. Purpose and Scope

This policy governs the creation, licensing, administration, and delivery of white-label training solutions, custom educational portals, and corporate learning programmes provided by Financial Mind (PTY) LTD (“Financial Mind”, “we”, “us”, or “our”) to third-party corporate clients, Financial Services Providers (FSPs), financial institutions, and corporate partners (“Corporate Clients”).

 

This policy operates in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA), the Financial Advisory and Intermediary Services (FAIS) Act 37 of 2002, and the Continuous Professional Development (CPD) guidelines set by the Financial Planning Institute of Southern Africa (FPI).

 

2. Legal and Regulatory Disclaimer

IMPORTANT NOTICE: All white-label learning modules, custom corporate portals, Security Awareness Training (SAT), Product-Specific Training (PST), and CPD content provided by Financial Mind (PTY) LTD are strictly for educational, continuous professional development, and internal competence training purposes.

  1. No Financial Advice: Neither Financial Mind nor its custom or white-label materials provide legal, tax, investment, or financial advice as set out by the Financial Sector Conduct Authority (FSCA).

     

  2. FSP Responsibility: Corporate Clients and FSPs remain solely responsible for their own regulatory compliance, advice oversight, and ensuring that their representatives fulfill all statutory FAIS Fit and Proper requirements.

     

3. Intellectual Property and Licensing Rules

  • Ownership of Core Content: Financial Mind retains exclusive ownership and intellectual property rights over all core courseware, video lectures, assessment banks, software scripts, and underlying learning methodologies.

     

  • Limited License: Corporate Clients are granted a limited, non-exclusive, non-transferable, revocable license to display and distribute white-label learning solutions to their designated employees or authorized representatives for the agreed contract term.

     

  • Custom Assets & Branding: Client-owned trademarks, logos, and proprietary brand guidelines used in white-label environments remain the exclusive intellectual property of the Corporate Client.

     

  • Prohibition of Reselling: Corporate Clients may not sub-license, resell, distribute, or expose white-label course content to external third parties without express written authorization from Financial Mind (PTY) LTD.

     

4. Platform Administration and Multi-Tenant LMS Rules

  • LMS Infrastructure: White-label training is hosted via our 3rd-Party Learning Management System (MoodleCloud) using dedicated client subdomains or multi-tenant portal configurations.

     

  • User Provisioning: Corporate Clients are responsible for providing accurate learner registration data (full names, ID numbers, employer email addresses, and FPI numbers) for account creation.

     

  • Access Control: Accounts are issued strictly to individual employees/representatives. Account credential sharing or bulk access violations will result in immediate suspension of affected accounts.

     

5. Data Protection and POPIA Compliance

  • Data Operator Role: In delivering white-label LMS solutions, Financial Mind acts as an Operator (or Joint Responsible Party) under POPIA regarding learner personal information uploaded by the Corporate Client.

     

  • Corporate Reporting & Consent: Learner progress, assessment results, completion certificates, and attendance logs are shared with the Corporate Client’s designated HR or Compliance Managers. Learner profiles must include clear consent acknowledging employer visibility over training completion status.

     

  • Data Retention: Learner training metadata and CPD logs are maintained for a minimum of 5 (five) years to satisfy FPI and FSCA compliance audit requirements.

     

6. CPD Accreditation and Custom Content Customization

  • Accreditation Integrity: Customizations to white-label courses must maintain alignment with FPI-accredited learning outcomes. Significant modifications to technical content, duration, or assessments require prior review by Financial Mind Subject Matter Experts (SMEs).

     

  • Certificate Issuance: Certificates generated via white-label portals will feature co-branding (Corporate Client logo alongside Financial Mind as the authorized FPI CPD Provider) and include unique verification hashes for audit purposes.

     

7. Contract Terms, Payments, and Service Level Agreements (SLAs)

  • Fee Structure: White-label setup fees, custom content development, and per-user licensing fees are defined in the specific Corporate Service Level Agreement (SLA).

     

  • Payment Terms: Setup and custom development fees are non-refundable once development has commenced. Annual/monthly LMS subscription fees must be paid in advance via electronic funds transfer (EFT) or secure payment gateway links (Yoco / Peach Payments).

     

  • Service Downtime: Financial Mind relies on MoodleCloud for hosting and maintains reasonable measures to ensure high availability, but is not liable for indirect losses caused by third-party infrastructure maintenance or telecommunications outages.
