1. Purpose and Scope
This Refund Policy governs cancellations, course fee refunds, and enrollment transfers for learning programmes, Continuous Professional Development (CPD) courses, Product-Specific Training (PST), Security Awareness Training (SAT), and corporate training solutions provided by Financial Mind (PTY) LTD (“Financial Mind”, “we”, “us”, or “our”).
This policy operates in accordance with the Consumer Protection Act 68 of 2008 (CPA) and the Protection of Personal Information Act 4 of 2013 (POPIA).
2. Legal and Regulatory Disclaimer
IMPORTANT NOTICE: All educational services, training materials, and CPD hours offered by Financial Mind (PTY) LTD are strictly for educational, continuous professional development, and competence training purposes.
No Financial Advice: Information provided within our learning modules, platforms, or administrative communications does not constitute legal, tax, investment, or financial advice under the Financial Advisory and Intermediary Services (FAIS) Act 37 of 2002, or as regulated by the Financial Sector Conduct Authority (FSCA).
Professional Discretion: Learners and financial service providers (FSPs) remain independently responsible for assessing course suitability and fulfilling their regulatory CPD obligations.
3. Cooling-Off Period and Cancellation Rights (Individual Purchases)
In accordance with Section 44 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the CPA:

7-Day Cooling-Off Period: Individual learners purchasing online courses directly are entitled to cancel their enrollment and request a full refund within 7 (seven) calendar days from the date of purchase.

Conditions for Refund: A refund during the cooling-off period will only be granted provided that:

The learner has not logged into the 3rd-party Learning Management System (MoodleCloud); and

No course content, video modules, assessments, or downloadable learning materials have been accessed, viewed, or downloaded.

Loss of Cancellation Right: Once a learner logs into the MoodleCloud platform or accesses any portion of the course material, the service is deemed rendered, and the statutory cooling-off refund right lapses immediately.
4. Non-Refundable Circumstances
Refunds will not be issued under the following circumstances:

Platform Access Initiated: The learner has logged into MoodleCloud or accessed course materials.

Lapsed Cooling-Off Period: More than 7 calendar days have passed since the purchase date.

Failed Assessments: The learner fails to achieve the required pass mark (e.g., 70%) on course assessments within the permitted number of attempts.

Incorrect User Data: The learner provides inaccurate personal, ID, or FPI membership details resulting in delayed or rejected CPD uploads.

Technical Incompatibility: Issues arising from the learner’s personal hardware, local internet connection, or third-party web browser settings.
5. Corporate and White-Label Training Agreements
Custom corporate training packages, group enrollments, white-label learning solutions, and SME-led workshops are governed by the specific payment and cancellation terms executed in the corporate service agreement:

Corporate retainer fees, setup fees, and custom content development costs are strictly non-refundable once development or platform provisioning has commenced.

Participant substitutions within corporate groups may be permitted prior to LMS account activation, subject to written notice and approval by Financial Mind.
6. Course Transfers and Deferrals

Individual Transfers: If an individual learner cannot complete a course due to verified extenuating circumstances (e.g., medical emergency), Financial Mind may, at its sole discretion, allow a transfer of the enrollment to another course or defer access for a specified period.

Administrative Fee: Approved course transfers or deferrals may be subject to a reasonable administrative handling fee.
7. Payment Gateway Processing & Disbursement

Payment Gateways: All course transactions are processed through our secure, accredited South African payment gateways, Peach Payments and Yoco.

Refund Disbursement: Approved refunds will be processed using the original method of payment (credited back to the card or bank account used during purchase).

Processing Timeline: Approved refund requests will be processed within 14 (fourteen) business days of formal approval. Financial Mind is not responsible for secondary banking processing delays introduced by card-issuing banks or gateway clearings.
8. Refund Request Procedure
To request a refund or course cancellation:

Submit a formal written request via email to admin@financialmind.college with the subject line: "Refund Request - [Your Full Name / Order Reference]".

Include your full legal name, South African ID number, proof of payment, transaction reference number (from Yoco or Peach Payments), and reason for cancellation.

Our compliance and administrative team will review the request against MoodleCloud LMS access logs and notify you of the outcome within 3 to 5 business days.
